Richland County Common Pleas Judge James Henson believed in September that Dustin Powers, a 36-year-old school teacher, deserved a second chance. So, despite the fact Powers had been convicted of sexual battery for having sex with a 13-year-old girl, Henson placed him on probation for five years.
Powers got a second chance, all right — to continue victimizing the girl. This week he was back in Henson’s court, after being caught having sex with the girl, now 15, again. This time, Henson sentenced Powers to four years in prison.
Henson maintains, given what he knew at the time, his initial decision to place Powers on probation was correct. We disagree. A school teacher caught having sex with a child should be sent to prison — period.
