Cops also found photos of two other underage girls, one nude and the other topless, in a side table by his bed, and they found 15,470 child-porn images and 700 child-porn video files on his computers. An Internet predator who knowingly had sex with a 13-year-old girl and took photographs and video of their sexual activities should be sentenced to five years in prison.
Crown prosecutor Diane Hollinshead argued that yesterday at a sentencing hearing for Quentin Tarry, 32, who has pleaded guilty to unlawfully sexually touching a person under 14 and possession of child pornography.
Hollinshead said it is aggravating that Tarry initially took no steps to ascertain the victim's age and then, after learning she was only 13, continued having sex with her.
"This is a young impressionable child whom Parliament has said cannot give consent. That is very aggravating."
Hollinshead said a further aggravating factor is there were multiple sex acts captured by camera and video.
Hollinshead also noted Tarry had admitted to a psychologist that he had had sex with a 14-year-old girl he had also met online and the psychologist concluded Tarry had displayed "predatory behaviour" over the Internet.
According to an agreed statement of facts, Tarry was 30 when he met the 13-year-old victim on an Internet dating service site for adults in the fall of 2005.
The girl, who cannot be identified under a court-ordered publication ban, initially told Tarry she was 19, but two weeks after meeting him and having two sexual encounters, she revealed her true age was 13.
Following her admission, the pair voluntarily engaged in sex on numerous occasions. Many encounters included a photo session where Tarry would take pictures and videos of both the girl and the two of them having sex.
It is illegal for an adult to have sex with a person under 14 regardless of whether the minor gives consent.
The illicit affair came to light after the victim's best friend told her mother about her pal's "new boyfriend" and she told the victim's mother, who then called police.
According to the agreed facts, the friend went to her mom after telling the victim that Tarry was too old for her and seeing him dancing nude via webcam on her computer.
In November 2005 police used a search warrant to raid Tarry's home. There, they found more than three dozen digital images of the pair having sex as well as videos.
Cops also found photos of two other underage girls, one nude and the other topless, in a side table by his bed, and they found 15,470 child-porn images and 700 child-porn video files on his computers.
After Tarry's first court appearance on Nov. 23, 2005, his mother said her son was "not a monster."
Defence lawyer Brian Beresh told court he would be seeking a conditional sentence to be served in the community when the hearing resumes on Jan. 11.
