Phill Rian - Loses custody of her children after sexually abusing them


A jury ruled unanimously Friday that Phill Rian, who was jailed for child sexual abuse in Round Rock, will not retain custody of her children.

Jurors heard closing arguments that focused on the Round Rock mother's 5-year-old son and 4-year-old daughter Friday.

In August Rian was sentenced to 23 years in jail after she was convicted of three counts of sexual assault of a child.

The county attorney asked the jury to terminate Rian's parental rights, so her children can be adopted into a permanent home.

Rian will no longer have contact with her two children. The verdict also terminated the parental rights of the children's father, Timothy Nagel, who did not show up to the trial.

Nagel lives in California and has been in and out of jail.

"In this type of case, nobody celebrates. There's not a victory for anybody. It's the right result because both parents are incarcerated and they can't be parents to these children," said Williamson County attorney Jana Duty.

The assistant county attorney had argued that the case was about the children, and it was Rian's poor judgment that brought them there.

"What was done here is what we asked to be done," said Chris Van Deuson, a spokesperson for Child Protective Services. "This gives the children a chance to have a forever family that they can grow up being with a permanent family that loves them and cares for them up until their 18 and beyond that."

Rian's attorney maintained that the 42-year-old mother loved her children and never placed them in any danger.

Rian may get one more chance to see her kids if a child psychologist allows one more meeting or a "goodbye" visit.

The children are in foster care, and there are no predictions on how long it will take to get a permanent family.
