A registered sex offender who got out of state prison four months ago has been indicted on charges he had sex last month with an underage girl.
Christopher J. McKinney, 25, of 48 DeKalb Road, Granville, faces charges of third-degree rape and third-degree criminal sexual act for an alleged sexual encounter with a 16-year-old girl on Dec. 12.
The charges do not allege he physically forced the girl to have sex, but have been brought because the girl was too young to legally consent. New York’s age of consent is 17.
McKinney served more than three years in state prison for a 2003 conviction for repeatedly having sex with a young girl. He served the maximum after he violated parole, and was released last Aug. 3.
Court records show he also was convicted of having sex with 7- and 5-year-old girls in Saratoga County in 2000. He was put on probation in that case.
McKinney was arrested by State Police on Dec. 16, after officers learned of the allegations made by the 16-year-old girl.
He is a Level 2 sex offender. Level 3 is considered the highest risk of re-offending.
McKinney is being held in Washington County Jail pending arraignment in Washington County Court.
