A man accused of forcing a 7-year-old boy into a Burger King restroom stall and then sexually assaulting the child has been charged with two first-degree felonies: sodomy upon a child and child kidnapping.While the boy's mother ordered food at Burger King, 5610 W. 3500 South, on August 15, the child went to use the restroom, where officials say Jorge Denis Gutierrez-Ortiz, 44, was waiting for just such a vulnerable victim.
Gutierrez-Ortiz "grabbed the boy and took him into the stall," charging documents said. He then undressed himself and ordered the boy to do the same.
Surveillance cameras recorded the man going directly to the bathroom after entering the restaurant. Cameras also recorded the man leaving the bathroom, then exiting the restaurant, before the boy came out, West Valley Police Capt. Tom McLachlan said.If convicted of sodomy upon a child, Gutierrez-Ortiz faces mandatory imprisonment with a presumptive sentence of 25 years to life, the document states.
First-degree felonies are generally punishable by a prison term of five years to life, with a minimum of 3 to 15 years, depending on the crime.
